The contents of the web site Polzela.com and all its versions is the property of Polzela tovarna nogavic d.d. Polzela 171, SI-3313 Polzela, Slovenia (hereinafter referred to as Polzela d.d.). With the use of the web site Polzela.com users accept the published general business conditions. These conditions describe, define and regulate the terms of use of the web site Polzela.com (accessible from the address www.polzela.com), and with the general conditions users regulate their mutual obligations when making purchases in the Polzela.com online shop which is the property of the company Polzela d.d.

With the use of/access to the web site and online shop the user accepts the present terms of use.

Polzela d.d. reserves the right to change the general conditions on the Polzela.com web site or to change any part of the page and delete any part of the content without prior notice. By accessing the web site the user confirms that he/she agrees with possible changes and modifications.

Polzela undertakes to present the information and updates as accurate as possible, however it shall not exclude eventual mistakes on the Polzela.com pages regarding prices, delivery periods, product descriptions, etc. and shall not assume any responsibility and liability for damages or other liabilities. Product images are of symbolic nature and might not represent the actual state of the products (colour, material, patterns, etc.).  The buyer has the right to return and exchange goods purchased in the Polzela.com online shop.

Visitors may use the content of the Polzela.com web site exclusively for non-commercial and personal purposes.  All content is copyright protected. Users may view and use the contents published on the Polzela.com web pages, however, without the permission of Polzela d.d. it is forbidden to publish, reproduce, distribute, copy or in any way use the logo and/or contents of the Polzela.com web pages. In case of any authorized use of the contents on those pages, all copyright marks and other notices and warnings shall have to be preserved. 


When using the Polzela.com web pages and the services the following is forbidden:
1. any race, national, religious, political and sexual discrimination;
2. carrying out web activities contrary to the law and other regulations;
3. to use the web page's services to send unwanted (inappropriate, advertisement, etc.) messages;
4. any form of harassment of third parties using our services.

In case of user violation of the present terms of use, conditions and instructions for the use of individual services, Polzela d.d. shall have the right to deny that particular user access to www.polzela.com.
Polzela d.d. may prevent the use of the Polzela.com web pages in case the user using Polzela.com harasses other users or violates their rights, uses the Polzela.com web pages for malevolent or unfair purposes or does not act according to the terms of use of the Polzela d.d. web site.

User registration

You can login to the Polzela.com web site as a registered user. The web site contents are also accessible to anonymous users. In the registration process, registered users submit the required information. Each registered user receives a secret username and password. The user shall guarantee that only he/she will use the username and password or an authorized person on his/her behalf. Each user shall be individually responsible for contents added to the Polzela.com web pages.

Polzela d.d. shall protect user personal information and prevent its misuse. Personal information shall be used only for purposes for which the user gave his/her consent.

By adding contents to the page, the user expressly allows Polzela d.d. to publish the contents publicly, and by adding contents to the page the user gratuitously, non-exclusively and until cancellation transfers to the company Polzela d.d. material copyright, namely:

- all the rights of use of a work in material form, especially the right of reproduction;

- all the rights of use of a work in non-material form (public notice), especially the right of public performance, the right of public transmission, the right of public broadcast with phonograms and videograms, the right of public presentation, the right of radio broadcasting, the right of radio retransmission, the right of secondary radio broadcasting and the right of making available to the public;

- all the rights of use of a work in modified form, including especially the right of processing and the right of audio-visual adaptation;

- all the rights of use of authorship work samples, i.e. the right of distribution and the right of rental.

The user shall not claim any refunds or payments in regards to the publication of submitted contents. 

The user expressly guarantees to use the web pages exclusively and only in such manner not to violate the rights (copyrights, as well as personal and other rights) of third parties or of Polzela d.d., to use the services in accordance with applicable regulations and not to use the web site in an illicit manner or for an illicit purpose. 

The user who will publish or submit contents for publication shall be entirely liable for the published or submitted contents, both for their content and for their quality.
The user shall not in any case submit contents for publication that include third parties who do not agree with the publication of such contents. The user shall not submit contents including any other details, because of which or on the basis of which any rights of third parties would be affected, nor shall submit contents in a manner that would cause any damage or that would be in contrast to the applicable law and regulations.

The user shall also expressly guarantee that he/she is the bearer of all copyright and related rights in regards to the submitted contents. The user expressly undertakes to submit all contents in accordance with the provisions of the law. 

The final buyer making purchases through the Polzela.com online shop shall be exclusively a registered user purchasing goods for personal purposes or for non-profit activities. The buyer using the Polzela.com web pages shall be exclusively a physical person.

Privacy and personal information protection

All the information that the user submits via forms on the Polzela.com web pages or otherwise (by phone, e-mail, fax, etc.) shall be confidential and Polzela d.d. shall treat such information in accordance with applicable law of the Republic of Slovenia. Polzela d.d. shall protect personal information and prevent its misuse. Personal information shall be used only for purposes for which the user has given his/her consent.

Irrespective of the provision referred to in the preceding paragraph, the user of the Polzela.com web site shall expressly authorize the submission of his/her personal information to contracting processors and third parties to ensure the services of the Polzela.com web site.

The user shall be also liable for the protection of personal information by safeguarding his/her username and password.

Polzela d.d. uses SSL technology, which is used to encrypt all information submitted via orders, to transfer all personal information. Credit card information, which is submitted in case of such a payment method, is transferred in encrypted form from your computer directly to the bank authorization server.

Reservations

Polzela d.d. shall ensure with its best efforts that the information on the Polzela.com pages is most accurate and up-to-date, however, Polzela d.d. warns the web site users that the texts are of informative nature, thus it shall not guarantee and shall not assume responsibility for the accuracy and entirety of the page. All users shall use the published contents on their own responsibility. Polzela d.d. shall not be liable for occasional non-functioning of the page, for possible information inaccuracy and for possible damages arising from the use of inaccurate or incomplete information, as well as for possible failures of internet providers.

Polzela d.d. may change the general conditions on the Polzela.com web site without prior notice. Polzela d.d. reserves the right to use any remedies and rights in case of violation of the present general conditions, including the right to block access to the web site from a particular IP address. Addresses in the general conditions are included exclusively for the transparency of the present general conditions and do not affect the content and interpretation of individual provisions or general conditions as a whole. The users agree that the use of this web site and the interpretation of the present general conditions shall be governed by the applicable law of the Republic of Slovenia.

All eventual disputes arising from the use of this web site or in any way related to the use of this web site shall come within the jurisdiction of the Court of Ljubljana according to the applicable law in the Republic of Slovenia.

Prices

All product prices are expressed in EUR and depend on the country. Valid prices are those confirmed by the buyer when placing an order via the online shop. The prices and discounts are valid when placing an order. For each purchase in the Polzela.com online shop an online purchase discount may be applied. Polzela d.d. reserves the right to change prices daily, unless otherwise stated. Prices listed in the Polzela.com web site do not include postal costs.
The validity of the special offers is listed on the Polzela.com online shop at the time of the special offer.
The prices listed are valid only for online shopping in the Polzela.com online shop and may differ from the prices at the Polzela points of sale and other points of sale. 

Order/purchase procedure

The Polzela.com online shop presents products which may be purchased. The order in the Polzela.com online shop is placed when the user receives an automatic electronic notification. This electronic notification is not a confirmation that the product is on stock or shipment is in progress. The order will be confirmed within 3 working days after submitting the order by an electronic order confirmation. In case that the ordered product is out of stock or the order could not be placed due to other reasons, the user will be informed by electronic mail. All the confirmed orders will be considered as irrevocable. In case of mistakes the buyer may without any extra costs cancel the order in the period of time before the receipt of the electronic order confirmation.

Polzela d.d. reserves the right to reject the order on suspicion that the Polzela.com web site might have been misused. By placing the order the buyer confirms that he/she is acquainted with the general conditions published on the Polzela.com web site. The purchase agreement is stored on Polzela.com, the buyer may access it any time through his/her online shop account.

Polzela.com gift vouchers purchased online are cashable only at sale points in Slovenia and within the period of time indicated on the gift voucher.

Products purchased in Slovenia may be given to other persons as a gift. The person for whom the gift is intended must have a delivery address in Slovenia. Polzela d.d. will carry out the voucher delivery and send an invoice to the buyer.

Payment method

Buyers in Slovenia can pay immediately upon delivery or by credit card.
When paying on delivery the buyer pays the post employee the purchase price.

The ordered goods remain the property of Polzela d.d. until the entire purchase price is paid.

Delivery

The expected delivery period of the ordered goods is 7 to 14 working days. All the products are delivered by the contracting partner Pošta Slovenije.
The prices listed on the web site do not include postal costs. If your amount exceeds 50 EUR, Polzela d.d. will cover the postage. A flat rate amount of 3 EUR (VAT included) is calculated for the package delivery.
The buyer must pay for the money order expenses to Pošta Slovenije in the amount of 0.96 EUR (service upon delivery).
Polzela d.d. shall not assume liability for eventual delays of the delivery service. Polzela d.d. may change the delivery pricelist at any time and may choose another delivery service, if it deems that the order will be executed in an even more efficient manner.

Return of goods and claims

The buyer has the right to inform Polzela d.d. within 15 days after the receipt of goods about the resignation from the purchase to the address spletna.trgovina@polzela.com. The buyer has to complete the form for the return/exchange of goods which can be found here and send it with the goods. The buyer should also enclose a copy of the invoice.

The returned products must be unused, intact, quantitatively unaltered and in their original packaging. The returned products must be accompanied by a copy of the original invoice. The buyer must return the goods to Polzela d.d. within 30 days after submitting a written notice to the address: Polzela tovarna nogavic d.d., Polzela 171, SI-3313 Polzela, Slovenia with the subscript: online sale.
The buyer is charged the costs of the return delivery of the product.
Polzela d.d. shall refund the entire purchase price immediately after receipt of the returned goods.

Polzela d.d. shall be liable for clerical errors of purchased products via the Polzela.com online shop. The buyer submits the claim via e-mail address spletna.trgovina@polzela.com. The buyer has to complete the form for the return/exchange of goods which can be found here and send it with the goods. The goods must be accompanied by a copy of the invoice. Polzela d.d. shall in five working days after the receipt of the buyer's written notice confirm the receipt of the claim and inform the buyer about the claim processing procedure.
